摘要
新中国成立以来,农地征收补偿制度大致经历了三次较大的历史变迁,呈现出征地补偿理念匹配地权制度、征地补偿行为凸显行政逻辑、征地补偿标准偏离土地价值、征地补偿立法迟滞化碎片化等制度逻辑,这种以"牺牲小我""服务国家"为导向的制度逻辑暴露出不合时宜的诸多弊端。在新时代全面深化改革的背景下,树立以人为本的征地补偿理念、推进农地征收补偿法治进程、确立土地征收补偿市场标准、健全失地农民参与协商制度,不失为推进农地征收补偿制度改革创新的路径选择。
Since the founding of the People’s Republic of China,the compensation system of farmland expropriation has roughly undergone three major historical changes,presenting the system logic that the idea of land expropriation compensation matches with the system of land rights,the compensation behavior of land expropriation highlights administrative logic,expropriation compensation standards deviates from the land value,and the legislation of land expropriation compensation is slow and fragment,and so on.This kind of system logic oriented by“sacrificing the ego”and“serving for the country”exposes many inopportune defects.Under the background of comprehensive deepening reform in the new era,it is the path choice to promote the reform and innovation of the compensation system for farmland expropriation to establish the concept of people-oriented land expropriation,to promote the law process of land expropriation compensation,to establish the compensation market standard and to improve the consultation system for land-lost farmers.
