摘要
上海海事法院(2017)沪72民初136号民事判决是我国海事法院作出的首例邮轮旅客人身损害纠纷判决,具有较为突出的典型价值。旅客摔伤等不存在海事因素的情形不属于海上人身损害,不应由海事法院管辖。旅行社包船模式下,旅客与旅行社、邮轮公司之间分别形成邮轮旅游服务合同、海上旅客运输合同法律关系,邮轮公司是邮轮旅游服务合同的履行辅助人。邮轮航行于公海时不存在对应的国内法律,导致我国现行法律适用规则难以适应邮轮旅游的特殊性。司法裁判应当避免邮轮旅游经营者的安全保障义务过度扩张,允许旅行社援引邮轮公司的法定赔偿责任限制权利,但不宜认可邮轮旅游经营者对于不存在海事因素的一般人身损害享受责任限制。
The(2017)Hu 72 Min Chu No.136 civil judgment of Shanghai Maritime Court is the first judgment of maritime courts on cruise tourism disputes in China.The division standard for the jurisdiction between local courts and maritime courts on cruise tourism disputes should be the influence of maritime elements,especially maritime special risks.The underlying contracts of the civil legal relations are tour contract,passage ticket and sales contract of passage ticket.The law at the locality of the provision of service is nonexistent for high seas.There are flaws to choose foreign law as the application law of the contract of carriage of passengers by sea,and the passage ticket clauses are not necessarily valid.The cruise travel agency is entitle to invoke the right of limitation of liability of the cruise company.
