摘要
传统价值观与现代法治观冲突的根源在于中西方的价值差异。这种冲突主要表现为私力救济的不同选择、权利和权力的差异认知以及对于"健讼"和"厌讼"的不同观念。传统价值观与现代法治观的冲突是各种因素长时间作用的结果,中国悠久的历史在某种程度上加剧了这种冲突。消弭冲突的关键在于制度本身具有价值、制度得以充分落实以及公民素质的有效提升。
The conflict between traditional values and modern concepts of rule of law is rooted in the value differences between China and the West.This conflict is mainly manifested in the different choices of private relief,the different perceptions of rights and powers,and the different attitudes towards“litigation”and“litigation weariness”.The conflict between traditional values and modern concepts of rule of law is the result of long-term effects of many factors,which is worsened by China’s long history to some extent.The key to eliminating conflicts lies in the value of the system itself,the full implementation of the system and the effective improvement of citizens’quality.
