摘要
党的十九大提出"树立和践行绿水青山就是金山银山的理念",这标志着我国的环境法制建设进入了一个新的历史时期,但是从当前少数民族地区环境法制建设的现状来看,经济发展缓慢、生态环境脆弱和地方法律制度的落后都给环境法制建设带来了阻碍。该文从广西少数民族地区的实际情况出发去进行分析,发现造成这种阻碍的因素是多种多样的,既包括了由于城市化进程给当地带来的环境破坏与少数民族地区教育水平的落后和环保意识的缺失,也包括了少数民族地区习惯法和国家法的冲突与当地环保资金投入不足等各种因素。因此,少数民族地区的环境法制建设要形成一个完善的体系,就需要普遍提高人民的教育水平和环保意识,政府要大力发展经济和制定环境法制建设的长远规划,这既是少数民族地区环境法制建设的必要保障,也是当地经济可持续发展的必要之举。
The the 19th National Congress of the Communist Party of Chinaputsforward "setting up and practicing the concept that Clear Water and Green Mountain are Gold Mountain and Silver Mountain",which marks that our country’s environmental legal construction has entered into a new historical era.However,judging from the current situation of environmental legal system construction in minority areas,low growth of economy,fragility of ecological environment and the backwardness of local legal systemhave brought obstacles to the construction of environmental law.Based on the analysis of the actual situation of Guangx’ si minority areas,this paper finds that there are various factors which cause such kind of obstructions,including the environmental damage caused by the urbanization process,the backwardness of education level in minority areas and the lack of environmental protection consciousness.In addition,the said factors also include the conflict between customary laws and national laws in the minority areas and the insufficient investment in local environmental protection funds.Therefore,to form a perfect system for the construction of environmental legal system in minority areas,it is necessary for the people to improve the education level and environmental protection consciousness,the government should vigorously develop the economy and make a long-term plan of environmental legal system construction,which is not only the necessary guarantee for the construction of environmental legal system in minority areas but also the necessary measuresto push sustainable development of the local economy.
