摘要在我国经济发展新常态下,加快制定《知识产权基本法》这一知识产权领域基础性法律,是深化知识产权领域改革、加快实现知识产权治理体系和治理能力现代化的制度需求,是建设中国特色知识产权制度的迫切需要,是积极参与和主导国际规则制定、推动形成全面开放新格局的现实考虑。在《知识产权基本法》的指导思想中,需要坚持保护权利、促进发展、开放互惠,充分发挥立法的引领和推动作用,加强法律制度顶层设计,夯实社会治理法律基础,建立市场配置创新资源的产权机制,形成有效激励创新的制度环境,推动实现经济提质增效转型升级。《知识产权基本法》立法需要处理市场与政府的关系、严格知识产权保护与促进知识产权运用的关系、法律规范与公共政策的关系、知识产权基本法与其他法律的关系、国内立法与国际规范的关系。《知识产权基本法》的基本原则包括,激励创新原则、私权神圣原则、诚实信用原则、严格保护原则和高效运用原则。 Under the new normal of China s economic development,accelerating the formulation of the Intellectual Property Basic Law,the basic law in the field of intellectual property,is the institutional need to deepen the reform of the intellectual property field,accelerate the realization of the intellectual property governance system and modernize the governance capacity,and is an urgent need to build an intellectual property system with Chinese characteristics,and is the realistic consideration of participating in and leading the development of international rules and promoting the formation of the new pattern of comprehensive opening-up.The legislation of"Intellectual Property Basic Law"needs to deal with the following relationships:the relationship between the market and the government in terms of basic positioning,the relationship between strict intellectual property protection and the promotion of using intellectual property rights in the main line of logic,and the relationship between the legal norms and public policies in the adjustment of means,the relationship between the Intellectual Property Basic Law and other laws in the institutional system,and the relationship between domestic legislation and international norms in the vision of development.The fundamental principles of the Intellectual Property Basic Law Intellectual Property include the principle of stimulating innovation,the principle sacred private right,the principle of honesty and credit,the principle of strict protection,and the principle of efficient use.
