摘要
文化为制度之母。当我们对某种法律现象进行深入探究时,就必然会触及它赖以成型的文化基因及其制度表达。"中国文化"与"中国民法"之间存在着紧密的文化—制度互动关系。中国古代民法观念和民法制度生成于传统中国特定的历史文化环境,体现了中国古人在法律发展变迁中作出的具有中国风格和中国气派的历史选择与文化自觉。在"旧邦新命"的文化语境中,中国近代民法与西方民法的趋同及其限度,诠释了近代民法与传统文化的关系,折射出中国近代民法与文化发展之间合规律性与合目的性的统一。新时代的《民法总则》将社会主义核心价值观作为立法宗旨,代表了当代中国民法典文化发展的新高度,反映了中国法学界以唯物史观整合中华优秀文化资源的价值底蕴和文化自信。这也表明,当代中国民法典的编纂唯有结合中国文化语境,才能充分和恰当地呈现民法的"中国特色"。
Culture is the foundation of various social systems.When we inquire into certain legal phenomenon,we have to pay attention to its cultural genes and institutional expressions.This type of relationship can be seen in the direct interaction between Chinese culture and Chinese civil law.The concept and the system of civil law in ancient China were generated in the ancient Chinese historical and cultural environment,reflecting the unique historical choices and cultural consciousness of the ancient Chinese people.In the cultural context of the“new life of the old state”,the convergence between civil law in modern China and western civil law and the limit to this convergence embodied the relationship between China's modern civil law and its traditional culture,and reflected the unity of the regularity and purpose of the development of Chinese civil law and culture in modern China.General Provisions of Civil Law made for the new era takes the core socialist values as the legislative purpose of building China's civil code,showcasing the new heights of contemporary Chinese civil code culture and speaking of the value and cultural confidence of Chinese legal scholars in integrating historical and cultural resources based on historical materialism.In this sense,it is safe to say that only when it is combined with Chinese cultural context can China's civil law show Chinese characteristics fully and appropriately.
