摘要
近年来,数字技术的普及与升级改变了作品的载体,数字版权应运而生。而现有法律制度无法充分应对数字技术交易风险,该风险体现在制度的不完善导致的"一权多卖"、版权集体管理制度的垄断和数字版权权利扩张引起的冲突等,贯穿于制度、管理和技术三个层面。这些数字版权交易的法律风险囿于法律制度的滞后性与数字技术的超前性之间的冲突,最终会影响版权人、交易相对人和公众的利益。研究发现,数字技术作为一种社会规范参与财产,具有利益平衡的功能,法律规范设计者应当深刻把握技术的本质属性后再进行规则的制定。对此,建议我国现代版权法律制度的改革坚守利益平衡原则,细化我国数字版权交易的基本法律制度,完善版权集体管理制度,明确特定网络服务提供者的版权侵权责任,构建合格的数字版权交易平台等,既要加强交易各方权利保护,同时应当合理激励互联网产业的有序发展。
In recent years,the prevalence and upgrade of digital technology has changed the carrier of works while the digital copyright has emerged.However,the existing legal system cannot fully cope with the risks of digital technology transaction.These risks are reflected in the"repetitive exchange of one work",the monopoly of the copyright collective management system and the conflicts caused by the expansion of digital copyright rights,all of which run through the levels of system,Management and technology.The legal risks of digital copyright are stuck in the conflicts between the lag of the legal system and the advancement of digital technology,which will ultimately affect the interests of copyright owners,counterparts of the transaction and the public.According to the study,as a social norm participating in property distribution,the digital technology has the function of balancing interests.The designers of rules should profoundly grasp the essential attributes of technology before making rules.In this regard,it is suggested that the reform of Chinese modern copyright legal system adheres to the principle of balance of interests,refines the basic legal system of digital copyright transactions in China,improves the copyright collective management system,clarifies the copyright infringement liability of specific network service providers,and builds qualified digital copyright transactions.It is necessary to strengthen the protection of the rights of all parties to the transaction,and at the same time,reasonably encourage the orderly development of the Internet industry.
