摘要
完整的国家反腐败立法包括预防腐败的公职人员伦理法。我国应当加紧进行公职人员伦理立法,结束目前公职人员伦理规范碎片化状态,为监察委员会提供完整的执法依据。在立法进路上,可制定专门的《公职人员伦理法》,以便与监察委员会职责范围全面对接。考虑财产申报制度的特殊性,可单独制定《公职人员财产申报法》作为公职人员伦理立法的组成部分。
Complete national anti-corruption legislation should cover the ethics concerning public officials so as to prevent their corruption.China should step up legislation on public officials'ethics,ending the current fragment status of public official’ethics norms meanwhile providing the supervisory commission with a complete basis for law enforcement.When coming to legislation,the special Law on the Ethics of Public Officials could be enacted to fully align with the duties and responsibilities of the supervisory commission.Considering the particularity of property declaration system,the Property Declaration Law for Public Officials could be formulated separately as an integral part of the ethical legislation for public officials.
