摘要
《侵权责任法》对于第三人侵权时雇主责任的归责原则未作出明确规定,而《人身损害赔偿司法解释》在效力上又与《侵权责任法》的效力相冲突。根据《人身损害赔偿司法解释》的规定,雇主与侵权第三人的责任方式应为不真正连带责任,侵权第三人为最终责任承担人。雇主作为一种转承责任,对于雇员的人身损害应该承担赔偿责任。雇主承担责任赔偿责任应以侵权第三人应承担责任为限,对受害雇员进行赔偿。
There is not clear regulations on the employer's liability in the Tort Liability Law.But the Validity of Judicial Interpretations on Personal Injury Compensation conflicts with the Tort Liability Law.According to the stipulations of judicial Interpretations on Personal Injury Compensation,the liability of infringement of the third party and the employer is unreal joint liability.Infringement of the third party is the person to take the final lia-bility.As vicarious employer should bear the liability for personal injury compensation.The responsibility of the employer would be within the limit of infringement of the third party to indemnify employee for their damage.
