摘要
通过考察我国近年来一些重大突发性灾难事件以及政府应对的情况,试图说明现代政府在救灾过程中应做到保障灾区群众生命财产安全、管理救灾物资的基本角色不能失位;要推动政府救灾角色从"主导"到"协调"的转变,完善救灾"地方责任制",将全局统筹和属地管理相结合;还应在"有限政府"理念下推进救灾工作的法治化进程,建立健全应急法律法规,保障其法律效力,建立健全巨灾风险保障体系。
By reviewing some major unexpected disasters in recent years in China and the situation of government's response,the article tries to show that the basic role of modern governments,such as ensuring the safety of life and property of the people in the disaster area and managing relief materials in the course of disaster relief,cannot be lost.It is necessary to promote the transformation of the government’s role in disaster relief from“leading”to“coordinating”,improve the“local responsibility system”of disaster relief,and combine the overall plan with the territorial management.Additionally,we should also promote the legal process of disaster relief work,establish and improve emergency laws and regulations,guarantee its legal effectiveness,and establish and improve a catastrophe risk protection system.
