摘要
执行程序与破产程序的衔接是司法实践中的一大难点。大量执行不能案件难以转入破产程序,表面上看是程序操作问题,实质上却反映了破产法的实施效果不佳。破产不是单纯的法律或财务会计问题,而是复杂的社会问题和经济现象。要通过破产来解决执行难的问题,不应仅仅着眼于执行程序与破产程序衔接的具体程序设计,更要从根本上消除破产制度的基础性缺陷,增强破产制度的竞争力。本文围绕破产程序与执行程序的竞争与共生关系,从利益对立的视角来分析执行程序被过度使用而破产程序被束之高阁的原因,指出必须从经济发展大局的高度来重视破产制度,通过统一各方利益、提升破产制度的吸引力来实现破产程序与执行程序的平衡与共生。
The connection between the procedure of execution and that of bankruptcy has been a great problem in judicial practice.A large number of cases that cannot be performed can hardly turned into the procedure of bankruptcy.On the surface,it seemingly results from the problem of procedure operation,but in fact,it reflects the ineffective implementation of the bankruptcy law.Bankruptcy is not a purely legal or financial accounting issue,but a complex social issue and an economic phenomenon.When solving the difficulty of execution via bankruptcy,we not only need to focus on the concrete procedure of the connection between the procedures of execution and bankruptcy,but also should fundamentally eliminate the basic defects of bankruptcy system and enhance its competitiveness.This paper focuses on the relationship of competition and symbiosis between the procedures of execution and bankruptcy,trying to analyze from the perspective of interest antagonism the reason why the procedure of bankruptcy is put on shelf in contrast of overuse of the procedure of execution,and points out that it is necessary to pay attention to the bankruptcy system from the height of economic development.We should realize the balance and symbiosis between the procedures of execution and bankruptcy by unifying the interests of the parties and enhancing the attractiveness of the bankruptcy system.
