摘要
非歧视待遇原则对移徙工人权利的保障,主要体现在入境权、不受歧视的一般性权利、工作的权利及工作条件权、结社和集会自由权以及刑事正当程序权利等领域。入境权中的非歧视待遇突破了传统属地主权原则,一般性权利中的非歧视待遇应区别适用,而工作的权利及工作条件权、结社和集会自由权以及刑事正当程序权利这些具体权利保护中适用非歧视待遇,应注意相关国际条约规定存在的冲突,予以协调。国际社会应加强国际合作,健全保护机制,切实履行移徙工人非歧视待遇义务。
The protection of the rights of migrant workers by the principle of non-discriminative treatment is mainly embodied in the fields of the right of entry,the general rights of non-discrimination,the right of work and the right of working conditions,the right to freedom of association and assembly,and the right of criminal justifiable process.Non-discriminatory treatment in the right of entry breaks through the principle of traditional territorial sovereignty,and the non-discriminatory treatment in the general rights should be applied distinctively,while the rights of work and conditions of work,the right to freedom of association and assembly,and the right to criminal justifiable process are applicable to non-discriminatory treatment,and the conflicts in the relevant international treaties should be paid attention and coordinated.The international community should strengthen international cooperation,improve the protection mechanism and fulfill the non-discriminatory treatment to migrant workers.
