摘要
农民集体和集体所有权的性质模糊,以及《物权法》规定的集体财产所有权管理制度不切合实际,导致集体所有财产缺乏完善的权益保护制度。在实践中,由于集体财产经营管理人员缺乏忠实义务和勤勉义务的约束,经营管理人员侵害集体财产的情况时有发生。在农民集体财产被侵害而集体负责人怠于追究侵害人的法律责任时,法律应允许农民集体成员以维护集体权益为目的提起派生诉讼。未来立法应明确集体成员的派生诉讼权利,并解决农民集体成员派生诉讼的原告资格、派生诉讼的前置程序与诉讼费用承担,以及派生诉讼的和解与撤诉等问题。
Due to the vague nature of farmers collective and collective ownership and the fact that the collective property ownership right management system stipulated in the property law is not practical,it leads to the lack of perfect rights and interests protection system of collective property.In practice,the management personnel of collective property are not bound by the duty of loyalty and diligence,and the situation which management personnel infringe on the collective property have occurred.When the farmer collective property is violated and the collective failure to investigate the legal liability of the infringer,we should allow farmers collective member to maintain collective rights to bring lawsuits.In the future legislation,we should clarify the right of derivative action of collective members,and stipulate the plaintiff qualification,prep program and the cost of litigation expenses,the reconciliation and withdrawal of derivative actions and so on.
