摘要
在"互联网+政务服务"模式的不断推进中,政务服务存在的隐患逐渐显露,主要表现为对个人信息数据的保护不力。在"互联网+政务服务"中,政府信息公开与个人信息保护存在一定的矛盾。鉴于此,处理政府信息公开与个人信息保护之间的冲突,应当确立二者在本质上相互促进的观念。对于公开的范围,采取同意与匿名化并存的方式;对于使用的界限,依照比例原则进行判断。
In the continuous promotion of the“Internet+government service”,the hidden defects of government services have gradually emerged,mainly manifested in the ineffective protection of personal information data.In the“Internet+government services”,there is a certain contradiction between the disclosure of government information and the protection of personal information.In view of this,in order to deal with the conflict between the disclosure of government information and the protection of personal information,it is necessary to establish the concept of mutual promotion between the two.In the scope of disclosure,the method of consent and anonymization shall be adopted.The boundary of use shall be in accordance with the principle of proportionality.
