摘要
随着网约车代驾新型共享经济形式兴起,司法实践中也出现了关于网约车代驾引发的交通事故侵权责任案件的不同判决和法律争议。针对以上情况,围绕涉案当事人之间法律关系的确定、网约车代驾交通事故案件责任主体的确定以及涉案当事人法律责任的划分等三个问题进行了阐述分析。
Designated Driving of Online Car-hailing is generating a new form of shared economy.In judicial practice,there are also different judgments and legal disputes about traffic accident tort liability cases caused by Designated Driving of Online Car-hailing.This paper focuses on how to determine the legal relationship between the parties involved,how to determine the main responsibility of the network about driving accidents and how to divide the legal responsibility of the parties involved in three issues.
