摘要
公众参与制度被引入我国地方立法活动后,取得了丰硕成果,近年来更因《中华人民共和国立法法》赋予设区的市地方立法权引起高度关注。公众参与立法牵涉面广、问题成因复杂,忽视或脱离其客观规律的研究,成果的科学性与合理性有待完善。对地方立法公众参与研究中存在的问题进行探讨,有利于未来我国地方立法公众参与的良性发展。
After public participation was introduced to local legislation activities of China,it has made plentiful and substantial achievements.In recent years,it has drawn high attention because of Legislation law of the People's Re-public of China(hereinafter referred to as the Legislative law)gives local legislative power to the cities containing districts.The public participation in the legislation has extensive involvements and complicated causes of the problems,so the scientific nature and reasonableness of the results of the study,which ignore or disregard the objective law of the development of things,is questionable.The paper combines the quantitative and qualitative change rules,and discusses some problems existing in the study of public participation in local legislation in order to benefit the healthy development of public participation in local legislation in the future.
