摘要
投标保证金制度在建筑业招投标中被广泛应用,而现行法律中关于投标保证金的法律性质并不明确,在司法实践中对其性质的认识有较大的差异。通过分析比较可发现投标保证金属于让与担保的类型,建议应该在法律中明确投标保证金的这一性质以指导招投标实务。
