摘要
近年来,我国城市物业管理纠纷呈现爆炸式增长态势。为了有效破解物业管理的困境,需要深入分析矛盾的成因。基于田野调查和机制分析方法,研究发现我国城市住宅小区物业管理过程中存在五大矛盾。这些矛盾综合作用,共同导致城市普通住宅小区的物业管理困境。从法律关系看,我国物业管理兼具私人性、集体性和公共性等三维属性。物业管理矛盾的生成机制在于无公德的个体、业主自治力不足和政府管理缺位。破解这些矛盾需要在政府主导下构建由政府、市场、社会三方共同参与,合作共管的物业治理机制。
In recent years,China′s urban property management disputes show explosive growth.In order to effectively break the plight of property management,we need to analyze the causes of contradictions.Based on the field investigation and mechanism analysis method;it is found that there are five contradictions in the process of property management of urban residential area in China.The combined effects of conflict cause the plight of cities ordinary residential district′s property management.From a legal relationship,China′s property management has the three-dimensional properties of private,collective and public nature.The generating mechanism of property management contradiction resulted from no public morality individual,owner autonomous power shortage and the absence of government.To break these contradictions needs to build the tripartite cooperation condominium property management mechanism,which is the joint participation by the government,market,social under the guidance of government.
