摘要
《中华人民共和国民法总则》对《中华人民共和国民法通则》诉讼时效规定作了较大修改,并调整了例外适用特别诉讼时效的范围。《中华人民共和国海商法》规定了一套相对独立的体系化、制度化的诉讼时效特别法规范,但并不能涵盖广义海商法,更不等同于海事审判面对的诉讼时效问题。《中华人民共和国民法总则》的生效和实施,势必影响海商法诉讼时效制度,影响海事审判中诉讼时效法律规范的解释与适用,也影响海商法诉讼时效制度的立法修改。通过总结《中华人民共和国民法总则》诉讼时效立法演变、修改依据、适用范围及其例外,分析海商法诉讼时效法律表现形式及其内容,在此基础上,着重讨论《中华人民共和国民法总则》对海商法诉讼时效制度的影响,以及在适用和解释法律时如何进行协调,并就《中华人民共和国海商法》诉讼时效制度的完善和立法修改提出建议。
The General Provisions of Civil Law of the People's Republic of China have made comparatively significant revisions to the provisions of limitation period in the General Principles of the Civil Law of the People's Republic of China and adjusted the scope of application of exceptional provisions regarding special limitation of liability.The Maritime Code of the People*s Republic of China has provided a comparatively independent set of provisions with respect to limitation period which is systematic and institutional,but it can neither cover maritime law in the broad sense,nor equal to issues of limitation period confronting maritime trial.The effectiveness and promulgation of the General Provisions of Civil Law of the People's Republic of China will definitely influence limitation period system of the Maritime Code of the People's Republic of China and the interpretation and application of such provisions in maritime trial,as well as legislative revision to limitation period in the Maritime Code of the People's Republic of China.This article aims to analyze the forms and contents of limitation period in the Maritime Code of the People's Republic of China in terms of summarizing legislative evolution,revision basis,application scope and exceptions of limitation period in the General Provisions of Civil Law of the People's Republic of China,and on that basis it emphasizes on the discussion of the influence of the General Provisions of Civil Law of the People's Republic of China on limitation period in the Maritime Code of the People's Republic of China as well as the issue of how to coordinate in the process of application and interpretation,then it puts forward advices regarding perfection and legislative revision to limitation period system in the Maritime Code of the People's Republic of China.
