摘要
民族传统体育作为宝贵的非物质文化遗产,丰富多样,地域特色鲜明。《非物质文化遗产法》对其保护重在行政管理,无法充分调动民众积极性;知识产权制度重在私权保障,保护模式多元,但分而治之的状态不利于民族传统体育的整体保护。在保有现行制度设计的基础上,针对民族传统体育的特殊性,探讨对其特有保护模式的构建,对于发掘民族传统体育的文化、经济和社会价值具有积极意义。
National traditional sports as valuable intangible cultural heritage, are rich and diverse, and have distinctive regional characteristics. The Intangible Cultural Heritage Law focuses on the protection of its administration, unable to fully mobilize the enthusiasm of the public;the intellectual property system focuses on the protection of private rights, protection mode is diversity, but the diversity mode is not conducive for the overall protection of the national traditional sports. On the basis of the present system,based on the particularity of traditional national sports, the study explores the unique protection mode, and it is positive to develop the culture, economic and social value of the national traditional sports.
