摘要
判理公开是审判公开的重要内容,直接决定了程序的正义性。没有判理公开的审判公开是不完整、不彻底的,并在一定程度上直接导致了司法腐败的产生。本文简明论述了判理的内容,判理公开的意义及其实行存在的困难以及解决途径。
The exposure of ratio decidendi directly decides the justice of procedure,which is the significant content of the open trial. The open trial without the exposure of ratio decidend is not complete and thorough, which may result in judiciary corruption on a certain degree. Therefore, the thesis concisely discusses the contents of ratio decidendi, the significance of the exposure of ratio decidendi, the difficulty in practice and the channel of resolution as well.
