摘要
1999年1月29日,香港终审法院对港人在内地所生子女在港的居留权案(又称“无证儿童案”)作出判决。引起很大的争议,争执的焦点是基本法的解释权问题。本文通过对基本法的解释权问题的阐述,指出其存在的一些立法不足。
On Januray 29th 1999,Hongkong's court of final instance pronounced decision on the case of mainlandbom children's residence rights( also named case of illegal children residents).The final judgement aroused intense dispute, focusing on the explanation rights of the Basic Law. By expatiating on the explanation rights of Hongkong Basic Law,this essay poins out its deficiency which needs further improvement.
