公私兼顾论:我国反就业歧视法行政实施机制构建研究 被引量:9

Administrative Enforcement Mechanism in China’s Employment Discrimination Law

摘要 当前我国反就业歧视法治建设的重心在于构建行政实施机制。世界各国或地区反就业歧视法行政实施机制纷繁复杂、类型多样,既有基于私人利益的行政调解模式、行政裁决模式,又有基于社会公共利益的行政处罚模式、咨询促进模式,还有公私兼顾的行政执法加行政调解或行政裁决模式。我国反就业歧视法行政实施机制应当公私兼顾,采用行政主管机关加内设专业机构模式,通过行政执法以维护社会公共利益,通过行政介入实现劳动者的平等就业权。我国反就业歧视法行政实施机制应加强公私合作,建立公私合作的行政裁决制度,设置行政责任,拓展公共利益的实现途径,公私合作共同维护社会公共利益。 It is time to center on the construction of applicable mechanism of administrative enforcement in China’s employment discrimination law. There are several models of administrative enforcement mechanisms in the worldwide. The first is administrative intervention based on private interests. The second is administrative implementation based on public interests. The third is administrative implementation plus mediation or adjudication based on integration of public and private interests. In China’s employment discrimination law, the theory of integration of public and private interests should be the legal basis to construct the administrative enforcement mechanism, and the administrative authority should vindicate the public interests with administrative implementation, and the internal professional agency would deal with employment discrimination disputes by administrative adjudication. The administrative enforcement mechanism should be of public-private partnership to establish administrative adjudication system, to vindicate public interests jointly by administrative sanction and private enforcement mechanism.
