摘要
全球化的深入发展促进了国际关系的民主化和法治化,中国的外交政策及其实践因此深受软实力和国际法的影响。在中国和平崛起的背景下,沿着国际法基本范畴的逻辑强化中国的外交软实力,有助于中国对外承担大国责任和提供国际公共产品。构建人类命运共同体的中国方案增强了国际法的人类主体性以及国家的主体间性。在本体论和运行论方面,中国外交软实力将依赖于其国际话语权、国际造法能力以及国际争端解决能力。国际法的原始性和开放性决定了国际政治在外交实践中的重要作用,在国际法和大国政治互动的基础上提高全球治理能力,也成为中国外交软实力强化的前提和基础。
The further development of globalization has promoted the democratization and legalization of international relations and as a result China’s foreign policy and its practice have been greatly influenced by soft power and international law, and the cultural attraction and the capacity to formulate international law significantly contribute to the strengthening of China’s diplomatic soft power. In the trend of China’s rising and de-globalization, to construct and strengthen China’s diplomatic soft power under the framework of basic categories of international law will help China to assume the responsibility of great powers to provide public products for the international community against the negative aspects of economic globalization. China’s ideal of building a community of shared future for mankind enhances the human subjectivity in international law and the inter-subjectivity of the states. In the dimensions of ontology and theory of operation, the development of China’s diplomatic soft power depends on its power of international discourse, the capacity of agenda-setting in international law-making and participation and control in international dispute settlement. The primitiveness and openness of international law demonstrate the important role of its connection with diplomacy, thus enhancing the global governance capabilities on the basis of the interaction between international law and politics among great powers and also becomes the precondition and foundation of strengthening China’s diplomatic soft power.
