摘要
当前教育领域内权利(力)行使现状混乱,致使权利(力)在行使、监督及救济过程中功能不全。因此,有必要考察教育制度的历史沿革,并从教育史及实在法的维度对此领域的权利网络进行厘定,以实现教育自主权利及教育管理权力的析分。本文认为教育权包含教育自主权及教育管理权等权利,其中教育自主权为含有兴办教育权利、学术自由权等权利的民事权利,而教育管理权则为含有教育制度设立、教育机构设立审查等权力的公权力。
Currently,the exercise of educational right(power)is in a state of confusion,which leads to the absence in supervision function and remedy function of that right(power).Hence,it is necessary,through reviewing the history of educational system and relevant substantive provisions, to distinguish educational autonomy from educational administration power.In this article,educational right(power) is divided into educational autonomy and educational administration power.The former contains some civil rights,such as right in development,freedom in academic. And the latter includes some public power,such as establishing power of legal provisions,review power in establishment of educational institutions.
