摘要
我国现行共犯制度在解决网络共犯问题时遇到了一些难题。面对这些问题,当前理论中有采"制度改革"态度者,亦有采"丰富内涵"态度者。综观当前发现的此类问题,显然可以分为"兼容性问题"和"逻辑失效问题"两类。前者可以在现行共犯制度的逻辑框架之内通过丰富理论内涵的方式加以解决,而后者则显然超出了传统的共犯制度逻辑的兼容范围。要解决所谓"逻辑失效问题",应当改变我国共犯制度的"主体间思路"为一种"单方化思路"。
The complicity system of our country is faced with some troubles when it is applied to solve internet accomplice problems.As for these troubles,some researchers argue we should reform the complicity system;others argue we should enrich correlative theories.In fact,all these troubles can be divided into two kinds:compatible problem and logically excessive problem.We can solve the former by enriching the correlative theory,but the latter obviously is beyond the compatible range of our complicity system.The radical way to solve logically excessive-problems is changing the thoughtway of our Country' s Complicity System from conjunct angle to unilateral angle.
