摘要
中国通行的犯罪构成理论与苏联的犯罪构成理论之间存在一脉相承的关系,但前者并非是对后者的全盘照搬,而是在移植与借鉴的基础上有所发展。大陆法系犯罪成立理论、英美法系犯罪成立理论和中国通行的犯罪构成理论各有其优缺点。中国未来犯罪构成理论的走向应当是:以中国现有的通行犯罪构成理论为主导,适当吸取其他犯罪成立理论模式的合理因素。
The current theory of constitution in China can be traced to the theory of constitution in former Soviet Union.But the former didn't copy indiscriminately the latter.In contrast,on the basis of inheriting the latter and using its experience,there were some developments in the former.There exist merits and demerits in the theory of criminal establishment in the continental law system,that in the Anglo-American law system and that in China.The coming trend of the constitution theory in China should be as follows:the current constitution theory in China should occupy the leading position,and at the same time the reasonable factors of other criminal establishment theories should be assimilated critically.
