基于收益最大化的专利池组建与管理策略分析:专利权人间的理性博弈

Analysis on Formation and Management Strategies for Patent Pools Based on Profit-maximization: A Rational Game Between Patentees

摘要 从专利权人加入专利池的利益动机着手,在专利权人理性博弈的基础上,分析了专利池管理的两大核心策略——独立许可策略和回授策略。建立专利池简化模型,提出专利权人理性人假设和必要专利价值相等假设,用负相关线性函数表达专利市场需求曲线。通过对比专利权人加入专利池前后的专利许可收益,推演专利池的组建条件。剖析了附加专利许可收益分配问题,推导了投资研发附加专利的必要条件。运用数学分析方法定量地明确了独立许可策略和回授策略的实施条件。以高新技术领域五个成功运营的专利池为样本进行实证研究。结果表明:独立许可策略可为专利权人带来额外的专利零售许可收益,是专利池首选的管理策略;回授策略是备选策略,在满足一定条件下才会实施。 Beginning from patentees’motivation to join patent pools,this paper analyzes two core management strategies of patent pools,namely independent licensing and grant back on the basis of a rational game between patentees.It sets up a simplified model of patent pools,and puts forward that the hypothesis that patentees are all rational men and the hypothesis that all essential patents’values.Negative correlation linear function is adopted to express the patent market demand curve.The patent pool forming condition is deduced by comparing the licensing revenues which a patentee can obtain before joining patent pools and after joining patent pools.After analyzing the licensing revenues distribution of additional patents,it derives the necessary condition for the investment in research and development of an additional patent.Mathematical analysis method is employed to quantitatively determine the implementation conditions for independent licensing and grant back.The empirical research is carried by taking five successful patent pools in high-tech fields as samples.The results show as follows:independent licensing is a preferred management strategy for it can bring a patentee additional patent retail licensing revenue;grant back is an alternative management strategy which will be implemented under certain conditions.
