摘要
国内对于律师调解中的方法研究并不丰富,大多停留在对律师调解制度的构建问题上。随着全国律师调解工作试点的开展,学术界和实务界越来越重视律师调解技能的探索。在律师调解实务中,律师应准确把握听众的心理诉求,创造良好的言谈情境,在恰当时机运用亚里士多德的信誉论证(ethos)、情感论证(pathos)和逻辑论证(logos)这三种说服手段,达到调解的目的,以化解纠纷,促进法治社会进程。
In China, the studies on lawyer mediation methods are not rich and most of them focus on the construction of lawyer mediation system. As China started to pilot lawyer mediation, more and more attention is paid to exploring lawyer mediation skills in academia and practice. In the practice of lawyer mediation, lawyers should accurately grasp the audience＇s psychological demands, create a good speech situation, use Aristotle＇s three methods of persuasion, namely ethos, pathos, and logos at the right time to achieve the purpose of mediation, resolve disputes and promote the process of building a society ruled by law.
