摘要
社会矛盾纠纷多元化解决机制中,律师的专业优势、职业优势和实践优势令律师调解得到重视,然而,律师调解工作依旧存在许多问题需要解决,其中之一就是律师调解员资质条件的统一问题。一定的专业水平与良好的道德品行,是律师调解员资质条件的主要内容,将抽象的资质条件进行量化,才能确保律师调解员资质条件的统一。建议由司法部制定统一律师调解员资质条件的规范性文件。
In the diversified settlement mechanisms of social conflicts and disputes, lawyers＇ mediation gets more attention because of the specialized, professional and practical advantages of lawyers. However, there are still many problems to be solved in lawyers＇ mediation, one of which is the unification of qualification requirements for lawyer-mediators. To be qualified, a lawyer-mediator must meet two important requirements -- a certain level of professionalism and good moral conduct. The unification of qualification requirements for lawyer-mediators can only be achieved by quantify-ing those abstract requirements. It is recommended that the Ministry of Justice works out a normative document to unify the qualification requirements for lawyer- mediators.
