摘要
本文主要通过两个案例来分析在评价创造性时,无论是对发明创造本身,还是现有技术都需要进行"整体性"考虑,以尽可能做到客观、公正,进而合理权衡专利申请人或专利权人与社会公众的利益。
This paper mainly evaluates the creativity through two case studies. It is necessary to consider the invention itself and the existing technology as the ＂integration＂, so as to be as objective and fair as possible, and then weigh the patent reasonably the interests of the applicant or patentee and the public.
