摘要
学校法人治理结构是基于产权关系而形成的法律关系,具有决策权、监督权与执行权相互分离、相互合作、相互制约的特点。当前,在建立公立中小学校法人治理结构的探索中,出现了校长办公会和理事会两种主要模式。本文依据法人治理原则和国家政策精神对其检视,发现这些模式均存在不同形式的权利配置不当现象,暴露出制度建设中的种种过渡性问题。基于上述分析,本文提出优化公立中小学校法人治理结构的路径,即加强学校党组织建设,充分发挥政治核心作用;完善学校理事会建设,优化校长负责制;改进校务委员会建设,完善民主决策程序;健全执行机构设置,形成权责分明的执行网络;优化学校自组织系统,落实监督权与参与权。
The public school corporate governance structure is developed based on the property right relations,asking independent,cooperative and restricted power of decision-making,supervision and enforcement. Presently,the principal administrative meeting mode and the council mode are main explorations of the governance structure in public school. Reviewed within the framework of public school corporate governance structure and state policy,these modes show different forms of improper allocation of power reflecting their in exhaustive characteristics. According to the analysis above,several optimizing strategies are suggested in this paper including enhancing the construction of the CPC in school as the political core role of school; establishing the school council to improve the principal responsibility system; strengthening the school committee to realize the democratic decision; developing a management system with a clear division of power and responsibility; constructing a wide range of self-organization system to put power of supervision and others into practice.
