摘要
林则徐是晚清时期重要的政治家、思想家和军事家,被誉为"睁眼看世界第一人"。综观林则徐宦海沉浮四十余载,其始终奉行"经世致用"的实干精神,积极推动地方刑事、民事司法改革,主动了解西方各国法律制度,并以普世遵行的国际法准则处理华洋纠纷。在治理地方、禁烟运动乃至中外交涉的政治实践中,林则徐逐步形成了一套比较完整的法治思想。作为开明士绅地主阶级的代表,林则徐的法治思想和法治意识难免有局限,但其法治思维的闪光处依然可为今人借鉴。
Lin Zexu who is praised as " the first man to the world with opening eyes",was an important statesman, thinker and strategist in the late Qing Dynasty. Looking at the ups and downs of Lin Zexu's officialdom for more than 40 years, it has always pursued the practical spirit of " using the world", actively promoted the reform of local criminal and civil justice, and actively understood the legal systems of western countries. And to abide by the universal norms of international law to deal with disputes in China. In the political practice of local administration, anti-smoking movement and negotiation between China and foreign countries, Lin Zexu gradually formed a set of relatively complete thought of rule of law. As the representative of the enlightened gentry and landlord class,Lin Zexu's thought of rule of law and consciousness of rule of law are bound to be limited, but their rule of law is inevitable. The flash of thought can still be used for reference.
