摘要
2016年6月14日,《关于在市场体系建设中建立公平竞争审查制度的意见》的正式印发,标志着我国公平竞争审查制度的正式建立。公平竞争审查制度起源于国外的竞争评估制度。我国在借鉴国外研究的基础上,根据我国国情建立起了适合我国经济、社会发展的公平竞争审查制度。在司法实践中大量存在行政垄断、地方保护主义、违规补贴、指定交易等限制竞争的行为,而我国《反垄断法》并不能消除这些妨碍公平竞争政策措施的负面效应,它更多体现的是一种"事后执法"机制。公平竞争审查制度的建立,有利于维护市场公平竞争秩序,有利于完善现有的反垄断体制,有利于让市场在资源配置中充分发挥作用;但从目前来看,我国现有的公平竞争审查制度在法律依据、制度设计、具体实施中等方面还存在一定的局限性,仍需进一步完善。
On June 14 in 2016, Opinions on Establishing a Fair Competition Censorship in the Construction of the Market System was officially issued, marking the official establishment of China's fair competition censorship. Fair competition censorship originated from the foreign competition evaluation system. On the basis of foreign research for reference, China has set up the fair competition censorship suitable for her economic and social development according to her own national conditions. In judicial practice, there are a lot of limiting-competition phenomena such as administrative monopoly, local protectionism, illegal subsidies and designated transactions. However, Antitrust Law currently implemented in China can not eliminate these negative effects of policies and measures impeding fair competition, more like a kind of “after-the-event law enforcement” mechanism. The establishment of the fair competition censorship is conducive to maintaining the fair competition order of the market, improving the existing antitrust system, and enabling the market to play a full role in the allocation of resources. However, from the current point of view, China's existing fair competition censorship has some limitations in terms of legal basis, system design and specific implementation, and needs to be further improved.
