摘要
有关退休权的样本裁判文书可分为超龄劳动者用工关系的认定、基于身份的退休权诉求、除名和离岗后的退休权实现、交通事故中超龄人员的误工费诉求四个议题。涉及到的学理问题和法律制度主要有超龄劳动者用工关系的认定、劳动权与退休权的关系、退休权的身份属性与制度内容、退休金与生活费及养老金的关系厘清与相关制度、劳动能力理论与制度建设等。司法实务的考察同时启发了退休权法律制度架构的设想,即基础理论上须明确退休权的概念、立法理念、基本原则与法律体系中的定位,退休权的实践方式可从宪法与法律制度两个层面展开。
Sample judgments on retirement fight can be divided into four groups: the relationship be- tween the overage laborer and the employer, the claim of retirement right based on identity, the realization of retirement fight after removal and departure, the charge for lost wages of overage personnel in traffic acci- dents. The issues in academic field and legal system are as follows: the determination of labor relations a- mong the overage laborers, the relationship between labor fight and retirement fight, the status attribute and system content of the fight of retirement, the relationship among pension, living expenses and retirement ac- counts, and the construction of relevant system, labor ability theory, etc.. The investigation of judicial practice has inspired the idea of the legal framework of retirement fight, the basic theory should include a clear definition of the concept of fight to retire, the legislative idea, basic principles and positioning in the legal system, the practice of retirement fight can be carried out from the two aspects of constitution and the legal system.
