摘要
技术侦查报告制度属于一种事后监督措施,通过对执法机构所享有的技术侦查权的运行情况进行要素分析和特征描述,发挥遏止权力滥用、反映打击犯罪实效、促进立法完善、加强社会监督的作用。英国以及我国香港地区的技术侦查报告制度经过十多年的发展,已积累了丰富的经验、形成了较为成熟稳定的体系。对这些经验的挖掘和对域外制度的比较,有助于我国建立技术侦查报告制度的探索,实现对技术侦查权的有效监督。
The system of technical investigation report is a kind of post supervision measure. By analyzing and describing the operating conditions of the technical investigation power enjoyed by law enforcement agencies, the system can prevent the abuse of power, reflect the actual effect of cracking down on crime, promote the perfection of legislation and strengthen the role of social supervision. After more than ten years＇ development, the technical investigation reporting system in Britain and Hong Kong has accumulated rich experience and formed a relatively mature and stable system. The excavation of these experiences and the comparison of the systems of these countries or regions are helpful to the exploration of the establishment of the technical investigation report system and the effective supervision of the right of technical investigation in China.
