摘要
目前国内地下商业地块使用权出让政策还处于探索阶段,地方政府对出让条件设置较随意,缺乏科学的理论依据与实践规则指导。作者通过对深圳车公庙丰盛町B302-U001·B107-U001地块、南京湖南路No.2006G25地块、上海黄浦江沿岸E14单元Z4-2地块、广州番禺区南村镇万博商务区地下空间1号地块及深圳车公庙B302-0115地块等土地使用权招拍挂出让案例分析与比较,发现出让条件主要由标的物和受让人两大要素构成,具体内容包括地块位置、用途、使用期限、面积、地下深度、地下建筑层数层高、地面建筑、产权、价格、竞买资格、保证金以及其他要求等。不同地下商业地块使用权招拍挂出让条件差异较大,交易双方需要从实际出发,具体问题具体分析。
At present,the transfer policy about the usage rights of underground commercial plots is still in the exploratory stage in our country,while local government sets arbitrary conditions for the transfer which is lack of scientific theoretical basis and practical regulation. Through the analysis and comparison of B302-U001·B107-U001 plot of Fengsheng town in Chegongmiao District of Shenzhen,No.2006 G25 plot on Hunan Road of Nanjing,Z4-2 plot of the E14 Unit in Huangpu River District of Shanghai,No. 1 plot of underground space in Huambo District of Guangzhou and B302-0115 plot in Chegongmiao District of Shenzhen,it is found that the conditions of transfer are mainly composed of the subject matter and the transferee,the specific content includes the location of land,the purpose of use,the use of period,area,depth of underground,underground building layers,ground construction,property rights,price,bidders＇ eligibility,margin and other requirements. The conditions for auction of different underground commercial plots usage right vary greatly,both sides of the transaction need to proceed from reality,to make concrete analysis of concrete conditions.
