摘要
人工智能技术水平已经取得较大提高,能够从事发明创造活动。在专利主体制度方面,人工智能具备成为发明主体的客观条件,需要克服其获得主体资格的现实困境并承认其所生成发明的可专利性。在专利审查标准方面,人工智能会使得发明数量急剧增多,应当提高专利授权要求。在专利审查机制方面,应当考虑到人工智能扩张了现有技术范围、提高了专利申请文件撰写能力,审查员应当借助人工智能提高审查能力。为促进研发,应当缩小人工智能生成发明的专利保护范围,促进许可机制便利化,从而适应人工智能发展的现实需求。
The artificial intelligence （AI） technology has been greatly improved,and it can engage in inventions and creative activities.In the system of patent subject, the artificial intelligence has the objective condition to become inventor.It needs to overcome the realistic predicament of obtaining the capacity as a subject and admit the patentability of the inventions.In terms of patent examination standards,artificial intelligence will increase the number of inventions rapidly,and the patent authorization requirements should be enhanced. In the patent examination mechanism,it should be taken into consideration that artificial intelligence has expanded the scope of existing technology and improved the writing ability of patent application documents.The patent examiners should improve the ability of examination with the help of artificial intelligence.In order to promote research and development,we should reduce the patent protection scope of inventions of artificial intelligence,promote the facilitation of licensing mechanism, and adapt to the practical needs of the development of artificial intelligence.
