摘要
从警察用枪引发关注的主要案型来看,警察用枪裁量权的必然性诞生于相关立法的原则性与警务实践的复杂性之间的冲突。警察用枪的裁量权行使,应当既能够保障警察执法的安全性,又能够体现警察用枪的审慎性;必须遵守合法性原则、比例原则和自我约束原则。警察用枪的立法,应由管理型、约束性立法向引导性、规范性立法转变。为了规范警察用枪裁量权行使,在程序设定上,警察用枪裁量权的前置程序可包括持有和领用枪支程序、现场表明身份程序、现场警告程序等;事后规范程序既是为了审查警察用枪的合法性与合理性,加强内部监督程序督促警察审慎用枪,对违规用枪行为依法惩戒。此外,还应当建立合理的信息公开制度,增进公众对警察用枪专业行为的理解与信任,提升警察用枪行为的正当性,提升警察执法的总体公信力。
By analyzing the typical public events of the police use of firearms during recent years, the discretion of the police use of firearms is derive from the conflict between the principle of relevant legislation and the complexity of police practice. The exercise of the discretion of the police should not only guarantee the security of police law enforcement, but also reflect the prudence of the police use of firearms. The police must abide by the principle of legality, proportion and self - restraint. We need to change the legislation of police use of firearms from management and binding legislation to guiding and normative legislation. In order to standardize the discretion of the police use of firearms, we can set the pre - procedure of the police＇s discretion, including the procedures of possession, receive of firearms, identification on site and warning on site ; the post - regulation procedure can review the legality and reasonableness of the police use of firearms, strengthen the internal supervision procedure to urge the police more prudent, and to punish the violators according to the law. then put the discretion on site of the police use of firearms under the sun, and eliminate the public suspicion and build the public credibility of the police use of firearms.
