微博侵犯名誉权的构成要件和抗辩事由研究

摘要 我国目前网络舆论的环境相对宽松,随着微博的市值突破200亿美元,微博用户超过5亿,使用和接触微博的用户越来越多,信息流更新速度、内容更加丰富以及言论的自由度更高,我们每个人都是自媒体,对于微博上的热点问题、新闻报道、娱乐八卦甚至微博用户的个人问题都能随时、随地以及随心地发表自己的意见。作为一个言论自由的交流平台在给用户带来自媒体体验的同时对微博用户的权利保护也带来了一定的冲击,微博侵犯名誉权现象层出不穷。本文通过从微博交流平台中侵犯名誉权行为的构成要件、救济途径以及责任的承担主体和方式等主要方面对微博平台中侵犯用户名誉权的问题进行研究论证。 At present, Chinese Internet public opinion environment is relatively big. As the market value of Microblog has gone beyond $20 billion and the number of Microblog users has more than 500 million, the number of people who use Microblog and contact Microblog is bigger and bigger. Meanwhile, the information update speed is quicker, the content is richer, and the speech on public affairs is freer. Each of us can make We-Media. People can be free to express their opinions on the hot issues, news, gossip and even the personal problems on Microblog at anytime and anywhere. As a communication platform for free speech, Microblog not only brings users We-Media experience, but also has some shock on users rights protection. There are endless infringement cases of the right of reputation on Microblog. This paper studies the violation of the right of reputation on Microblog platform according to infringement acts constitutive requirements, relief approaches and the undertaker and bearing methods of responsibility.
