摘要
我国的宪法宣誓制度移植自西方成文宪法国家,考察其功能实现应注意其所深嵌的社会结构和文化语境,其中世俗性的法律传统和脆弱的信任现实构成了其文化嵌入性。为实现宪法宣誓制度的规制、实施、凝聚功能,有必要从提升宪法宣誓制度实施的外部与内部语境、促进公民宪法信仰的生成与发育、树立宣誓者的宪法宣誓观念等方面寻求文化嵌入性制约的突破。
The constitutional oath system of our country has been transplanted from the country of the Western written constitution. It is necessary to pay attention to its deep embedded social structure and cultural context,in which the secular legal tradition and the fragile trust reality constitute its cultural embeddedness. In order to realize the regulation,implementation and cohesive function of the constitutional oath system,it is necessary to seek the breach of the restriction of cultural embeddedness from the aspects of promoting the external and internal context of the constitutional oath system,promoting the formation and development of the citizens＇ constitutional belief,and setting up the oath concept of the oath.
