摘要
网络募捐作为借助互联网的一种新兴募捐方式,具有速度快、影响大、地域广的特点,越来越多的人选择通过网络募捐来获得及时帮助,度过难关。但由于监管不到位、法律不健全、信息真假难辨、平台缺陷等多种原因,造成捐款余额处理难、主体资格规范难、信息公开难、转发人责任确定难等问题屡见不鲜,且已成为影响正常网络募捐活动的重要阻碍。为此,网络募捐事业要长远发展,需采取监管主体多元化、介入第三方监管以及健全网络募捐法律法规等多种手段,以规范和引导网络募捐行为,使网络募捐真正在法制的框架下得以良性运行。
As a new wTay of fundraising with the help of the Internet,the network fund-raising has the characteristics of fast speed,great influence and wTide coverage. More and more people choose to collect donations through the network to get help in time and through difficulties. Ho＇wever,due to many reasons, such as inadequate supervision, imperfect law, difficult to judge false information,and platform defects,it is difficult to deal wTith the balance of donation,the difficulty of the main qualification of the main body,the difficulty in information disclosure and the difficulty of determining the responsibility of the forwarders,＇which have become important obstacles to the network collection activities. For this reason,the network fund-raising want to be developed in the long run, it is necessary to adopt a variety of means, such as the pluralism of the subject of supervision, the intervention of the third party supervision and perfecting the laws and regulations of network donation, so as to standardize and guide the behaviors of the network fund-raising, so that the network fund-raising can be truly operated under the framework of legal system.
