摘要
在庭前会议阶段,应当赋予被告人及其辩护人针对任何非法证据拥有排除申请权,但被害人及其诉讼代理人只有在自身合法权益遭受直接侵害的前提下才可以成为排非的主体。在启动要件上,申请人必须提供相关线索或材料,且这些线索或材料须达到引起法官合理怀疑的内心确认程度。在制度互动方面,应实现程序优先审查与庭审实质裁断的衔接,由负责庭审的法官担任庭前会议的主持人,且在庭前会议阶段排除非法证据必须区分不同情况。在庭前会议阶段没有提出非法证据排除,而在庭审中提出的仍然有效,法庭仍须依法进行非法证据排除程序优先审查。
The new criminal procedure law has established the procedural rule of illegal evidence exclusion for the first time in legislation, the relevant judicial interpretations of the Supreme Court and the Supreme Procuratorate further refined the exclusionary rule of illegal evidence. There are still some problems in the application starting procedure of illegal evidence exclusion. Illegal evidence before the meeting of exclusion program including start, review, disposal and other links, the starting procedure is the pretrial conference stage exclusionary program to open the first link, the litigants, the defenders and legal representatives of illegal evidence exclusion which is also a main factor for program start. In view of the new criminal procedure law and related judicial interpretations, it is necessary to analyze the starting subjects and elements of illegal evidence exclusion in pretrial conference and put forward some countermeasures.
