摘要
在国际工程EPC项目中,总承包商面临的风险种类丰富多样,不仅面临项目所在国家政治、法律、自然、社会环境以及经济风险,还需要承担项目设计、采购以及施工的主要风险。据调查可知,总承包商合同管理相比传统的EPC模式以及DBB模式而言,难度变得更大。通过国际工程EPC项目中合同管理现状,分析目前项目主要的履约问题、合同争议、索赔管理措施以及合同争议解决方式,从而探索国际工程EPC项目合同管理经验。
In EPC projects, the general contractor is exposed to a wide variety of risks. It not only faces the political, legal, natural, social environment and economic risks of the country where the project is located, but also takes on the major risks of project design, procurement and construction. According to the survey, general contractor contract management becomes more difficult than the traditional EPC mode and DBB mode. This article will introduce the contract management status of EPC projects in the world and introduce the main performance issues, contract disputes, claims management measures and contract dispute resolution methods in current EPC projects so as to explore the contract management experience of EPC projects in the world.
