摘要
跨行政区划法院改革是探索建立与行政区划适当分离的司法管辖制度的核心内容。目前借助铁路运输法院开展的跨行政区划法院改革试点,形式上是将一种跨行政区划法院改造为另一种跨行政区划法院,内容上是对某些特殊类型的案件实行跨行政区划集中管辖,不能充分体现跨行政区划法院性质和功能的独特性。同时,在司法地方化问题不断改善的情况下,是否将去地方化作为设立跨行政区划法院的基本任务,也是需要认真审视的。在设立跨行政区划法院改革探索中,应当抛弃去地方化的单一功能设计,立足于法院制度的整体重构,对现行按行政区划设立的法院和跨行政区划的专门法院案件管辖进行重新定位,根据区域发展的需要,重新规划法院管辖体制,建立与行政区划适当分离的司法管辖体制。
The reform of building cross-district courts is the core component of a new jurisdiction system which is relatively separated from the current division of administrative districts in China. The current pilot project of building cross-district courts on the basis of railway transport courts is turned one type of cross- district court into another one in form while in content it is actually intended to implement the concentration of some special cases from different districts in terms of jurisdiction. This reform, however, fails to fully show the uniqueness in the essence and function of real cross-district courts under discussion in this paper. With the progress in the solution to the problems caused by the judicial localization, it is also necessary for us to seriously consider whether de-localization should be set as the basic task for building cross-district courts. As a matter of fact, such a thought should be discarded that the de-localization is the only purpose for the building of cross-district courts. On the contrary, the key to the success in this reform lies in the following aspects： to re-define the jurisdiction of the courts established according to the current administrative district division and of the special courts cross these districts, aiming to restructure the whole court system; to re-design the jurisdiction system of the courts according to the needs for development and to establish a jurisdiction system appropriately separated from the current administrative district division.
