我国职务作品奖酬制度法律问题研究 被引量:1

摘要 我国有必要在著作权法第三次修订的过程当中完善职务作品奖酬制度。职务作品奖酬包括作者因完成法人或者其他组织工作任务所创作的作品而从单位获得的奖励和报酬,应当属于一种特殊劳动报酬,并且职务作品应当包括著作权属于单位的职务作品、法人作品、电影类作品。职务作品奖酬具有形式多样化、复杂性、不确定性的特征。我国职务作品奖酬制度的立法完善应当遵循利益平衡原则、约定优先与法定限制相结合原则、激励作者创作和促进作品传播原则、重视程序性保障原则。我国职务作品奖酬制度的司法完善有以下路径:确定合理的诉讼时效标准;实行举证责任倒置规则;建立完整的职务作品奖酬计算方法体系;建立职务作品奖酬多元化纠纷解决机制。 In order to protect the legitimate economic interests of the author of work-made-forhire,the deficiency and perfection of the system of reward and reward for the job works in China have been studied.According to the labor remuneration,the object of intellectual property,contract rights said the lack of analysis of the theory and the provisions of the copyright law in our country,points out the work reward meaning;the author to complete the tasks of legal persons or other organizations of the works from the unit to obtain a special labor remuneration,including reward and remuneration.The characteristics of post works reward:a form of diversification,complexity and uncertainty;in addition,this paper points out that the perfect our country’s duty work reward system should adhere to the balance of interests,and the legal limit agreed priority combination,the creation and dissemination of works to promote the incentive,pay attention to the principles of procedural safeguard.The Countermeasures for perfecting the reward system of official works in China are discussed:determining the standard of limitation of action,implementing the inversion rule of burden of proof,establishing a complete system of remuneration calculation for work creation,and establishing a diversified dispute resolution mechanism of job creation reward.
