摘要
竞业禁止规则在《劳动合同法》中有明确规定,《最高人民法院关于审理劳动争议案件适用法律若干问题的解释(四)》也对其进行了补充,但是由于理论上的不足,导致该规则在实践中暴露出一定的缺陷,尤其是《劳动合同法》对竞业禁止背后法律关系认知的片面,还有对意思自治原则的不当引用,都造成了对劳动者劳动权的严重侵害,具体体现在竞业禁止义务主体、范围和地域、期限、补偿金和违约金等方面。本文除了揭示竞业禁止法律关系中容易被人忽视的竞争利益法律关系,还代替意思自治原则引用"权利位阶法则"和"谦抑性原则",从各个具体方面提出完善《劳动合同法》中竞业禁止规则的方案,以保护劳动者的劳动权这一基本权利,体现《劳动合同法》的价值取向,维护社会利益,构建和谐社会。
The rules of non-competition prohibition are clearly stipulated in the Labor Contract Law, but because of the theoretical shortcomings, the rules are exposed to great defects in practice, especially the one side of the legal relationship, as well as the wrong reference to the principle of autonomy, have caused serious violations of the labor rights of workers, embodied in the non-competition obligations of the main body, scope and geographical, duration, compensation and liquidated damages and so on. In addition to revealing the legal relationship of competitive interests which is easy to be neglected in legal competition, this article also refers to the principle of "right order" and "modesty principle" instead of the principle of autonomy of will, and proposes the perfect labor contract law from various aspects "In the non-competition industry to prohibit the rules of the program to protect the labor rights of the workers the basic rights, embodies the Labor Contract Law value orientation, safeguarding social interests, building a harmonious society.
