摘要
非法证据排除规则在我国刑事诉讼法中占据着重要的地位,它的实施有力地推进了我国法制建设的进步。但是该规则在实际运行中也存在许多亟待解决的问题,如:非法证据排除程序中证明责任不清、当事人辩护权得不到有效行使、"毒树之果"是否应当予以排除等等。文章介绍了几个代表性国家和地区的相关制度规定,分析他们对此类问题的解决方式,通过学习和借鉴国外的有关经验,再结合我国的司法实践和基本国情,针对我国刑事诉讼法非法证据排除规则中出现的若干问题进行研究探讨,提出相应的建议和解决方案,促使我国非法证据排除规则的运行更加顺畅。
The enforcement of the rule of exclusion of illegal evidence has promoted the legal construction of our country,which occupies an important position in the criminal procedure law.However, there are many problems to be solved in the actual operation of this rule,such as the unclear burden of proof in the illegal evidence exclusion procedure,the lack of effective exercise of the parties＇ right to defense, whether the fruit of the poison tree should be excluded, and so on. This paper discusses some problems in the exclusion rule of illegal evidence in criminal procedure law, introduces several representative countries in foreign countries, analyzes their solutions to the related problems, and learns and draws lessons from the relevant experiences of foreign countries. Combined with the judicial practice of our country The author puts forward the corresponding solutions and suggestions in order to make the rule of illegal evidence exclusion run more smoothly in the future.
