摘要
逻辑一致是逻辑基本规律之同一律的要求和表达。作为行为评价的主要意义在于保持思维的确定性,是形成正确认识的必要条件。在法律制度体系内,作为司法裁判论证,逻辑前提的事实认定,在不同的诉讼领域并不要求作一致性认定,逻辑的"同一律"并不被作为评价裁判的工具。在民事诉讼领域内部,因为诉的多因素性,同一案件事实也可能在不同案件中重复出现,案件法律事实的认定也可能出现逻辑矛盾的问题,如果这种违背逻辑"同一律"思维错误不被重视则必然诱发裁判公正问题。
Consistent logic is the requirement and expression for the law of identity in the foundational of logic. The main significance of behavior evaluation is to maintain the certainty of thinking and it is a necessary condition for correct understanding. In the legal system,as the judicial adjudication and the factual determination of the logical premise,it is not required to make a conformity determination in different litigation areas. The＂law of identity＂of logic is not used as a tool for evaluating judges. In the field of civil lawsuits,because of the multi-factor nature of the lawsuit,facts in the same case may also appear repeatedly in different cases. There may also be logical contradictions in the determination of the legal facts of the case. If this logic of violation of the ＂law of identity＂is not valued,it will inevitably lead to injustice.
