摘要
从整体上观察和把握道德与法律之间的相互关系,需要从法治意识与道德自觉的关系研究入手,法治意识的功能体现在法治建设中的法律制度建构和法制的运行与实施中。公民所认同的道德规范能够内化于心,外化于行,这便是道德自觉的内核。通过各种层面的影响,实现法治意识与道德自觉的有效衔接成为中国法治模式的基本维度;实现法治人格培养的法律启动,塑造守法精神作为法治人格培养的基础工作,唤起道德自觉及培养法治主体观念作为法治人格培养的主体要件成为法治人格培养的核心工程。
Observing and grasping the relationship between morality and law as a whole requires starting with the study of the relationship between the consciousness of law and the consciousness of morality. The function of the consciousness of the rule of law is embodied in the construction of the legal system in the construction of the rule of law and the operation and implementation of the legal system. The moral norms recognized by citizens can be internalized in the mind and externalized in the line,which is the core of moral self-consciousness. Through various levels of influence,the realization of effective convergence between the sense of law and moral consciousness has become the basic dimension of China＇s rule of law; the legal initiation of the development of the rule of law personality and the creation of a law-abiding spirit has become the basis for the cultivation of the rule of law personality; and evoking moral consciousness and cultivating the rule of law are the main elements of the cultivation of the personality of the rule of law.
